The civil rights organization has alleged that Mosby was a victim of a politically motivated and malicious prosecution by the Trump administration, according to the Baltimore Banner.
Mosby, a vocal supporter of the Black Lives Matter movement and critic of police, was allegedly targeted by former US Attorney General William Barr. This followed her pledge to prosecute federal agents if they were deployed to Baltimore by President Trump in an attempt to quell the violent BLM protests of 2020.

The NAACP has also criticized the Biden administration for overlooking the supposed political motivation behind Mosby's prosecution. In February, Mosby was found guilty of falsifying a mortgage application to secure a lower interest rate. This conviction followed a November 2023 guilty verdict on two perjury charges related to the withdrawal of funds from the City of Baltimore's Deferred Compensation Plan.

Facing a potential 40-year prison sentence, Mosby used Covid-related hardship as a reason to withdraw funds from her retirement account to purchase a condominium on Florida's Gulf Coast. She stated that the $5,000 down payment for the property was provided by her former husband.

In their letter to President Biden, the NAACP expressed deep concern over the alleged abuse of power by the previous administration to push a baseless indictment against Mosby. They also criticized the current administration's Department of Justice for ignoring the apparent political motive behind the prosecution.
The civil rights organization believes that federal officials, including former President Trump, were incensed by Mosby's commitment to racial justice and accountability. In a February 2020 address to law enforcement, AG Barr reportedly criticized prosecutors like Mosby.

The NAACP's letter stated, “We expect that political persecutions and malicious prosecutions pursued during the Trump Administration would not continue in the Biden Administration. Ms. Mosby’s case is not the only one — it is the latest and one of the most egregious cases. This matter should be corrected because it is a miscarriage of justice and an example of the last administration’s misuse of authority.”

Derrick Johnson, the NAACP's president and CEO, argued that Mosby's conviction exemplifies how the legal system disproportionately targets black Americans. The NAACP claims that Mosby was the only individual charged among 739 people who committed similar offenses.

Johnson said in a statement, “We’ve watched, decade after decade, as black Americans have faced wrongful prosecution at the hands of those who seek to promote injustice. The only thing Marilyn Mosby is guilty of is the desire to provide her family with a better life. The sad reality is, as black women take their rightful places in positions of power, dark forces seek to tear down both their progress, and that of our community. The NAACP refuses to stand idly by as injustice takes the wheel, driving us down a path of further disparity. We are proud to stand alongside our partners in calling on President Biden and the Department of Justice to reemphasize their commitment to racial equity by pardoning Attorney Mosby. Enough is enough. It’s time to stand with black women.”
