The Department of Homeland Security (DHS) under President Biden's administration, led by Alejandro Mayorkas, is reportedly contemplating a strategy to grant legal status to immigrants unlawfully residing in the United States but married to American citizens.

According to a report by the Wall Street Journal, White House officials and some DHS members are exploring ways to prevent the deportation of long-term US residents who lack legal status. The proposal, which has gained traction within the Biden administration and DHS, involves examining various options to provide work permits to immigrants living in the country illegally.

Approximately 1.1 million immigrants married to US citizens are currently residing in the country without legal status. Typically, non-citizens married to Americans can secure a green card upon marriage. However, many who entered the country unlawfully may be denied this immigration status due to their illegal entry, which is considered a criminal offense.

The Wall Street Journal reports that the policy currently favored by the Biden administration is known as "parole in place." This policy has been used sparingly for veterans married to illegal immigrants on a case-by-case basis. The Biden administration has employed a similar approach to admit refugees from Ukraine and Afghanistan in recent years.

Implementing this program would eliminate numerous regulations hindering illegal immigrants married to US citizens from obtaining a green card and legal status in the US. Sources familiar with the process estimate that around 700,000 of the current illegal immigrant spouses in the US would qualify for this change in legal status.

Under the Biden administration, illegal immigration has surged dramatically, with records for monthly illegal border crossings being shattered multiple times. The number of illegal immigrants from China has also seen a staggering increase, rising by 4,000 percent since 2021.
