In a recent appearance on Fox's "Hannity," Alan Dershowitz, a former Harvard law professor, criticized the case brought against former President Donald Trump by Manhattan District Attorney Alvin Bragg.

Dershowitz argued that the case is "depriving" voters of a "fair election" and called for the presiding judge to recuse himself.

The trial, which commenced on Monday, revolves around allegations that Trump falsified business records to pay adult film actress Stormy Daniels in an attempt to silence her. Fox host Sean Hannity questioned Dershowitz about the escalated charges against Trump and the potential conflict of interest involving Judge Juan Merchan's daughter.

Dershowitz, speaking as an undecided voter, expressed his desire for a fair election. He argued that the case is depriving the American public of this right. "This case is depriving the American public – I’m speaking for the American public not for either candidate – of the right to have a fair election," Dershowitz said.

He further argued that Trump should be campaigning in Pennsylvania, but his ability to do so is hampered by the case. Dershowitz criticized the statute that allows the prosecution to veto the judge's decision to permit Trump to leave the courtroom, calling it unconstitutional and urging for the case to be challenged.

Dershowitz also expressed concern over the judge's power, which only allows Trump to leave the courtroom conditionally. He emphasized that the case is an example of "election interference."

When Hannity questioned Dershowitz about Judge Merchan's decision to remain on the case, Dershowitz pointed to the judge's daughter as a potential conflict of interest. He argued that Trump's lawyers should immediately make a motion against the judge's power, calling the gag order unconstitutional.

Dershowitz also expressed frustration with the weaponization of the legal system, stating that regardless of political affiliation, the public should be appalled. He argued that voters have the right to decide who to vote for without interference from the criminal justice system.

When asked if he believed Judge Merchan should recuse himself, Dershowitz responded affirmatively. He argued that the judge's daughter could potentially profit from her father presiding over the case, creating a conflict of interest.

In early April, Judge Merchan expanded a gag order on Trump after the former president criticized the judge's daughter for comments she allegedly made about him online. Trump argued that Merchan had a conflict of interest due to his daughter's political stance. However, the New York State Unified Courts system stated that the account was misattributed to her.
