In a recent development, a Texas magistrate judge has ordered the release of illegal immigrants who were apprehended during a tumultuous border incident in El Paso.

The immigrants had reportedly stormed the border, leading to a confrontation with National Guard troops.

Magistrate Judge Humberto Acosta issued the release order during an online bond hearing, according to the El Paso Times. "It is the ruling of the court that all the rioting participation cases will be released on their own recognizance," Acosta declared.

The judge expressed his disapproval of the El Paso District Attorney's Office for their lack of readiness to proceed with detention hearings for each defendant. It is anticipated that another hearing for additional accused individuals will take place on Monday.

This development follows the arrest of 79 illegal immigrants last week by Texas authorities. The individuals were charged with misdemeanor riot offenses in relation to the violent border incident.

An Immigration Customs and Enforcement (ICE) official informed the New York Post that over 200 illegal immigrants are currently in ICE custody in connection with the incident. However, the official noted that federal authorities "are not being as cooperative as Border Patrol," which could complicate the process of charging these individuals.

The exact number of immigrants detained on suspicion of "riot participation," a Class B misdemeanor, remains uncertain. However, Acosta indicated that "hundreds of arrestees" were entitled to 48-hour hearings in individual custody.

Acosta rejected a request from Assistant District Attorney Ashley M. Martinez to delay the hearings. "So if the DA’s office is telling me that they are not ready to go, what we’re going to do is we’re going to release all these individuals on their own recognizance," Acosta stated during the hearing.

The rioting immigrants reportedly damaged state-installed border wire and clashed with troops as they attempted to enter the US via Gate 36. They were hoping to be apprehended and granted entry by Border Patrol officials on the other side.

National Guard soldiers in the vicinity were redirecting small groups of single adult migrants back into Mexico shortly before the border stampede. The rioters subsequently decided to charge at the guardsmen.

Authorities reportedly confiscated knives and shanks from several rioters, according to a National Guard source who spoke to the New York Post. During the confrontation, at least one illegal immigrant attempted to seize a soldier's firearm.

Several soldiers stationed near Gate 36 were taken to a local hospital for treatment of minor injuries following the incident. In response, Texas has increased the number of National Guard troops and Department of Public Safety troopers in El Paso and has added more border wire to discourage unauthorized crossings and encourage migrants to use official ports of entry.
