Legal Expert Drops Bombshell In Biden Classified Documents Case

In a recent development, Andy McCarthy, a former federal prosecutor, has suggested that President Joe Biden should extend a pardon to ex-President Donald Trump.

This comes in the wake of special counsel Robert Hur's testimony on Tuesday, which concluded that Biden should not face charges despite his deliberate withholding of classified documents. McCarthy, speaking on "Fox and Friends," argued that Trump, who is currently facing charges related to classified documents, should be pardoned to eliminate the perceived double standard.

Brian Kilmeade, the show's host, questioned McCarthy about the primary difference between Biden's case and Trump's, which is often attributed to Trump's lack of cooperation. McCarthy responded, "That’s a terrible way of distinguishing them because cooperation is not a basis to not charge somebody." He further explained that cooperation is a factor considered during sentencing, not in determining guilt.

McCarthy drew an analogy to a murder investigation, stating, "Like, for example, in a murder investigation, once the murderer knows he has been caught, it’s frequent that they will let you, you know, search the house, they will give you a statement." He emphasized that even in such cases, the murderer's cooperation does not absolve them of their crime.

During the hearing, lawmakers from both parties frequently brought up the issue of Trump and his classified documents. Republicans used this as an opportunity to underscore the alleged double standard, while Democrats pointed out the differences in cooperation between the two cases.

McCarthy, addressing Kilmeade, stated, "Yesterday confirmed what I have been saying for a couple of months, which is that Biden should pardon Trump on the classified documents counts in the Florida case." He suggested that if the primary difference between the two cases is Trump's obstruction and Biden's cooperation, then all charges related to classified information should be forgiven. He concluded, "Treat Trump and Biden the same way, and try Trump on obstruction."
