The Biden administration anticipates a significant surge in the population of migrants with uncertain legal status residing in the United States, with estimates reaching approximately 8 million by October.

This figure represents a more than twofold increase since 2019, with over 8 million individuals having unlawfully crossed the border into the US since Biden's inauguration in 2021.

The ongoing crisis at the southern border shows no signs of abating, leading to an anticipated further backlog in the already overwhelmed immigration court system. A large proportion of those entering the US illegally seek asylum, with court dates set 5 to 7 years in the future. Due to Biden's reversal of Trump's mandate for asylum seekers to wait in Mexico for their hearings, these individuals now reside in the US during this waiting period.

One such case is that of Jose Ibarra, who illegally entered the US from Venezuela in September 2023, filing an asylum claim alongside his wife and her five-year-old son. Subsequently, Ibarra was arrested in New York City for child endangerment, released, and his record sealed. He then relocated to Georgia, where he was arrested and charged with the murder of Augusta University nursing student Laken Riley.

As reported by Axios, the Immigration and Customs Enforcement (ICE) currently has approximately 40,000 detention beds, a mere fraction of what is required to accommodate the millions of illegal immigrants who have flooded into the country since Biden's reversal of Trump's stringent border measures.

Those not detained by ICE are included in the "non-detained docket." Government predictions obtained by Axios indicate that an estimated 2 million of the 8 million individuals expected to have entered the country by October will be classified as "high-priority cases." These include individuals who have received deportation orders or have criminal charges or pending criminal charges.

At the onset of Biden's presidency, the "non-detained docket" comprised around 3 million people. Over the subsequent three fiscal years, this figure has escalated, reaching 3.7 million in FY2021, 4.8 million in FY2022, and 6.2 million in FY2023. If the predicted 8.1 million is reached by the end of FY2024, it will represent a 167 percent increase since the beginning of his presidency.

The Biden administration has been criticized for its inaction in addressing the crisis at the southern border, with officials opting to attribute blame to Republicans rather than assuming responsibility. Last year, Department of Homeland Security Secretary Alejandro Mayorkas asserted that the border was "secure." He has since been impeached due to his failure to rectify what both Democrats and Republicans have repeatedly identified as a flawed system.
