The activists, affiliated with the left-leaning climate justice group Declare Emergency, are accused of dumping red powder on the case containing the historic document on February 14. The Department of Justice stated that the act resulted in damages exceeding $50,000.

During the incident, the activists asserted that only wealthy white men benefit from the rights outlined in the Constitution and expressed intentions to "foment a rebellion." Following their actions, Zepeda and Green were arrested by officers and taken into custody.
