The Congressional Hispanic Caucus (CHC), led by Chair Rep. Nanette Díaz Barragán (D-Calif.), has expressed strong disapproval over the potential changes to the asylum process that President Biden may introduce.

This comes amidst mounting criticism over the situation at the southern border.

In a statement released on Thursday, Barragán acknowledged the challenges posed by Republican-led opposition to Biden's funding requests aimed at addressing the border crisis. However, she emphasized the CHC's opposition to any "unilateral attempts by the White House to change our asylum system and put human lives at risk."

Barragán expressed disbelief at the possibility of the White House resorting to executive actions to limit or prevent migrants from seeking asylum at the southern border. She noted the potential use of methods similar to those employed by former President Trump. "Migrants have a legal right to seek asylum when they arrive at our border. Asylum has provided refuge for families, women, and children, and other vulnerable populations since World War II," Barragán stated.

She further argued that executive action is unlikely to effectively address the issue. "Many of the changes reportedly being discussed would do little to reduce the stress or number of migrants that continue to arrive at our Southern Border," she said. "Enforcement-only policies do not work. And using immigrant communities as a political pawn is wrong."

The potential for Biden to resort to executive action has sparked backlash from immigration advocates and progressives. Reports suggest that Biden may use presidential authority to "suspend the entry" of foreign nationals deemed not in the country's best interests.

The Biden administration has previously exercised this power in relation to sanctions against countries such as Russia and Myanmar, and to prevent the entry of individuals at high risk of spreading disease.

Barragán stated that the CHC has not been consulted on any potential executive actions. However, she affirmed the caucus's readiness to collaborate with the administration and Congress members of any political affiliation. She emphasized the need for "real common-sense solutions, not just punitive actions" to address the immigration system and provide necessary resources for an orderly process at the southern border.
