In a surprising turn of events, President Joe Biden is reportedly considering executive action to address the ongoing border crisis, according to White House sources.

This news has been met with significant attention from mainstream media outlets. As reported by Axios, "One bold move that Biden has considered... is an executive order that would dramatically stanch the record flow of migrants into the Southwest." The report also suggested that this action could take place within the next two weeks, allowing Biden to claim proactive measures ahead of the State of the Union address.

Politico, two days later, revealed that Biden was contemplating a series of new executive actions and federal regulations, which would signify a comprehensive new approach to a problem that has been a persistent challenge for the White House. As noted by Brad Slager, a colleague at RedState, this development contradicts previous claims that Biden was eagerly waiting for Congress to pass legislation so he could take action.

This news also undermines years of assertions from the Biden administration that his "hands are tied" and that there was "no border crisis." It appears that the looming election year and the dwindling patience of voters are pressuring Biden to take action, despite his previous claims of lacking the power to do so.

The reports of Biden considering action on the border issue during an election year to gain an upper hand over Republicans caught the attention of House Speaker Mike Johnson (R-La.). In a statement released on Thursday afternoon, Johnson criticized Biden's attempts to deceive voters and urged him to implement "critical reforms," including reinstating former President Donald Trump's "Remain in Mexico" policy.

Johnson's statement read, "House Republicans have been sounding the alarm about the catastrophic effects of President Biden's open border policies since he began his term. Last year, I sent a letter to the President to demand he take immediate executive action. He has thus far ignored my demands, and the pleas from big city mayors, border state governors, and the American people."

Johnson further criticized Biden for only showing interest in making changes using legal authority he previously claimed not to possess, after the border had been surrendered to cartels and smugglers, and after the tragic loss of American lives due to fentanyl poisoning.

Johnson also highlighted the President's alleged intention to invoke Section 212(f) of the Immigration and Nationality Act, which the White House had previously dismissed. He urged the President to show his seriousness by changing more than just asylum policy, suggesting the reinstatement of the "Remain in Mexico" policy and ending the administration's abuse of the parole system, among other critical reforms.

Interestingly, Biden's power to shut down the border, if he chooses to do so, comes from a Trump-era border case that went to the Supreme Court. The majority ruled that under Section 1182(f) of the Immigration and Nationality Act, Trump had the authority "to temporarily suspend the admission of certain classes of aliens into the United States," as explained by former immigration judge Matt O'Brien.

This situation is particularly ironic given that Biden, who has consistently labeled Trump and his supporters as "racists" and "bigots" for wanting to secure the border, is now contemplating taking similar actions. Furthermore, Biden can do so partly because Trump, during his administration, fought back against Democrat critics and their lawsuits to ensure he and future presidents would have that power.
