In a recent episode of ABC News' "This Week," host George Stephanopoulos and Senator JD Vance, a Republican from Ohio, engaged in a heated exchange over the former President Trump's potential defiance of Supreme Court rulings deemed "illegitimate."

Vance suggested that the Constitution allows the President to disregard certain Supreme Court rulings. "The Constitution says that the Supreme Court can make rulings, but if the Supreme Court said the president of the United States can’t fire a general, that would be an illegitimate ruling," Vance stated. He further argued that the President must maintain his Article 2 prerogative under the Constitution to manage the military as he deems appropriate.

Vance continued, "This is just basic constitutional legitimacy. You're talking about a hypothetical where the Supreme Court tries to run the military. I don't think that's going to happen, George. But of course, if it did, the president would have to respond to it. There are multiple examples throughout American history of the president doing just that."

Stephanopoulos questioned Vance on whether the President must comply with legitimate Supreme Court rulings. When Vance responded, Stephanopoulos retorted, "You've made it very clear you believe the president can defy the Supreme Court."

Vance attempted to clarify his position, but his microphone was muted as the show transitioned to a commercial break.

The conversation was sparked by comments Vance made on a podcast in 2021, where he suggested that if Trump were to be reelected in 2024, he should "clean house."

Vance stated on the podcast, "I think that what Trump should do, like if I was giving him one piece of advice, fire every single mid-level bureaucrat, every civil servant in the administrative state, replace them with our people. And when the courts – because you will get taken to court – and then when the courts stop you, stand before the country, like Andrew Jackson did, and say the chief justice has made his ruling, now let him enforce it."

Stephanopoulos challenged Vance's comments, asking, "Fire everyone in the government, then defy the Supreme Court. You think it's OK for the president to fire the Supreme Court?"

Vance clarified that he did not suggest firing everyone in the government, but rather mid-level bureaucrats. He argued that there is a significant issue with administrators and bureaucrats in the government who do not respond to the elected branches.

Vance cited an example from 2019 when Donald Trump, after defeating ISIS, proposed redeploying troops from Syria and Jordan. According to Vance, several members of the Defense Department bureaucracy opposed this move, resulting in troops remaining in the Levant region.

"That's a fundamental component of our government, George, that whoever is in charge, agree or disagree with them, you have to follow the rules. If those people aren't following the rules, then, of course, you've got to fire them," Vance asserted. He concluded by emphasizing the President's right to run the government as he sees fit, a principle he believes has been undermined by bureaucracy over the past 15 years.
