Presidential hopeful Vivek Ramaswamy has revealed his intention to file an amicus brief to the Supreme Court, challenging the Colorado ruling that excludes former President Donald Trump from the 2024 Republican primary ballot.

The announcement was made during Ramaswamy's appearance on Wednesday's episode of Timcast.

Ramaswamy, who had initially intended to keep his plans under wraps, stated, "I am submitting an amicus brief to the Supreme Court arguing for why they need to overturn Colorado's disastrous decision to try to keep Donald Trump off the ballot." He further justified his decision, saying, "It's the right thing to do for this country. As somebody who is trained in the law, I feel a sense of obligation to do that."

The Supreme Court, following an appeal from Trump and his legal team, announced last week that it would review the case. Oral arguments are slated for early February.

The Colorado ruling has sparked similar attempts in other states to remove Trump from their ballots. Following Colorado's decision, Maine's Secretary of State Shenna Bellows also excluded Trump from her state's ballot. Other states, including Michigan and California, contemplated the move but ultimately refrained.

The argument against Trump's candidacy hinges on Section 3 of the 14th Amendment, which disqualifies individuals guilty of insurrection from holding elected office. This provision, enacted post-Civil War, aimed to prevent Confederate leaders from securing federal elected positions. In Colorado, a lower court ruled against Trump's removal but controversially labeled his post-2020 election actions as an "insurrection."

Trump, who disputed the 2020 election results and pursued legal recourse, has been accused of inciting the J6 Capitol protest, during which an unarmed Trump supporter was fatally shot by police. This event has been characterized as an insurrection, a claim used by Colorado's highest court to justify Trump's removal from the ballot. Trump's campaign has since appealed this decision to the Supreme Court.
