Lawsuit By Capitol Officer Brian Sicknick's Former Girlfriend Against Trump And Rioters Greenlit By Federal Judge

In a year marked by legal challenges for former President Donald Trump, a lawsuit was initiated by Sandra Garza, the ex-partner of the late Capitol Police Officer Brian Sicknick.

Sicknick tragically passed away following a series of strokes the day subsequent to the infamous January 6 riots.

Garza's lawsuit, lodged in January 2023, contends that Sicknick's demise was a "direct and foreseeable consequence" of the actions of Trump and two rioters, Julian Khater and George Tanios, on that fateful day. A medical examiner had previously concluded that Sicknick's death was due to "natural causes," adding that "all that transpired [on January 6] played a role in his condition."

Court documents reveal that a federal judge in Washington, DC, ruled on Tuesday that the lawsuit could advance, albeit only on two of the five counts. United States District Judge Amit Mehta dismissed the wrongful death count, as Garza was not legally recognized as Sicknick's spouse or domestic partner, and thus lacked the standing to bring the claim to court. Despite being a representative of Sicknick's estate, this was not deemed sufficient.

Judge Mehta also dismissed the two negligence civil counts, but permitted Garza to pursue the defendants on the two counts related to DC's Survival Act. This act allows a deceased person's legal representative to continue pursuing legal action on their behalf.

"We are pleased to see that our lawsuit in pursuit of justice for the late Capitol Police Officer Brian Sicknick, who died in the aftermath of the January 6th insurrection, has been permitted to continue," stated Attorney Mark Zaid following the decision, as reported by Axios. "We are now considering our next step options, to include deposing former President Trump."

Trump, as he has done in other cases, sought to claim immunity. However, this assertion was rejected by Judge Mehta.

As reported by CBS News, both Tanios and Khater have been prosecuted for their actions on January 6. Khater received a sentence of over six years in prison after confessing to spraying Sicknick, while Tanios pleaded guilty to less serious charges. Neither Tanios nor Khater have faced criminal charges in connection with the officer's death.
