Hunter Biden's legal team has reportedly threatened to call President Joe Biden as a witness if the Department of Justice proceeds with pressing charges against Hunter.

This revelation comes after news emerged that there was sufficient evidence to pursue Hunter for the illegal purchase of a firearm during a period of drug addiction.

The potential of having a sitting president testify is said to have influenced Hunter's plea deal, which ultimately fell apart in July when Judge Maryellen Noreika discovered that the diversion agreement aimed to shield the first son from charges related to his foreign business dealings.

According to a letter obtained by Politico, attorney Christ Clark wrote, "President Biden now unquestionably would be a fact witness for the defense in any criminal trial. There can be no doubt that these leaks have inserted President Biden into this case." Clark further argued that this case neither warrants a sitting president testifying at a criminal trial nor the potential constitutional crisis that could ensue.

Hunter's legal team also asserted that targeting him for tax crimes would severely damage the reputation of the Department of Justice. They cited the relentless political pressure from opponents of the current president, particularly Donald Trump, who had long called for an investigation into the Bidens.

Although Clark, who referred to the gun charges against Hunter as "constitutionally dubious at best," has since left Hunter's legal team, he may be called as a witness if the case proceeds to trial, where the details of the negotiations could be brought up.

Following the collapse of the plea deal, both the tax and gun charges against Hunter were dropped in Delaware. However, Special Counsel David Weiss announced that they could potentially be refiled in California or Washington, DC.
