Landmark Victory: Supreme Court Backs THIS Contentious Biden Admin Policy

The Supreme Court has rejected a challenge by Texas and Louisiana to a deportation policy implemented by the Biden administration.

The policy, which was introduced in September 2021, allows the Department of Homeland Security to prioritize the arrest of recent border crossers, those who have committed crimes and suspected terrorists due to a lack of resources to pursue the more than 11 million illegal immigrants who could be subject to deportation.

The challenge was based on the claim that the policy violated federal law. However, the court ruled 8-1 in favor of the Biden administration, with Justice Samuel Alito being the only dissenting justice.

In his majority opinion, Justice Brett M. Kavanaugh wrote that the lawsuit brought by the states was "extraordinarily unusual" and that federal courts have not traditionally entertained that kind of lawsuit. Kavanaugh also stated that the Executive Branch's decision not to arrest or prosecute does not infringe upon interests that courts often protect. He added that the Executive Branch has the authority to decide how to prioritize and pursue legal actions against defendants who violate the law.

The ruling lifted a lower court ruling that had blocked the policy, and the justices ruled that the states lacked legal standing to challenge the policy shift. Kavanaugh clarified that the ruling does not suggest that federal courts may never entertain cases involving the Executive Branch's alleged failure to make more arrests or bring more prosecutions. However, he emphasized that there are good reasons why federal courts have not traditionally entertained lawsuits of this kind.
