In a recent development, the Institute for Justice has launched a lawsuit to end forfeiture proceedings targeting several individuals whose assets were reportedly confiscated by the FBI without sufficient justification.

The case is rooted in an incident where the government seized over $100 million from safety deposit boxes in California without clearly explaining their action.

At the epicenter of this legal contention are Linda and Reggie Martin, a Los Angeles couple who insist that the FBI wrongfully seized $40,200 from their safety deposit box, amounting to their entire life savings. The Martins and several other victims had their belongings abruptly taken from a financial storage facility in Beverly Hills in March 2021.

"The FBI took my savings nearly two years ago but has never told me why. It's been a confusing and frustrating process from the day my money was taken. No one should have to go through this," commented Linda, as quoted in the Institute's press release.

The court documents filed by the Institute for Justice revealed that the FBI reportedly seized an estimated $100 million in cash, gold, jewelry, and other valuable items from multiple individuals at the Beverly Hills location. It appears that the FBI issued blanket notices indirectly referencing many federal crimes but refrained from specifying the actual wrongdoing committed by the Martins or the other victims.

Rob Frommer, Senior Attorney at the Institute for Justice, emphasized the role of civil and criminal forfeiture as a significant revenue source for federal law enforcement. "Thousands of times every year, people receive paltry notices that merely say the government wants to forfeit their property because it might be wrapped up in one of hundreds of federal crimes," he stated.

Highlighting Linda's ordeal, Frommer pointed out the controversial practice of federal forfeiture: "Linda's plight highlights the ugly truth that federal forfeiture incentivizes agents to seize as much as they can, even absent any reason to think that a crime was committed. The FBI's 'policing for profit' deliberately leaves property owners in the dark in order to keep them from fighting back."

The lawsuit, filed in the U.S. District Court for the District of Columbia, calls on the court to cease administrative proceedings for all who received one of these forfeiture notices from the FBI.
