Perry shot Garrett Foster during a Black Lives Matter protest in 2020. With the high level of violence, threats, and the situation that Perry was in, most people did not anticipate that he would be found guilty of murder.
The Post Millennial says, “Perry, a former Army sergeant driving Uber at the time, encountered an armed BLM group that had taken over the streets of Austin, Texas, during a riot on July 25, 2020. According to KXAN, Perry faced one count of murder and one count of aggravated assault with a deadly weapon. The jury did not find him guilty of the second charge.”
Austin Police Department released a description of the alleged incident. Perry was an Uber driver at the time. He took a wrong turn and wound up on a street that was being blocked off by protestors. Foster was in the group of protestors and armed with a rifle. The mob quickly surrounded his car, and Foster allegedly pointed a gun at Perry.

Perry then fired from inside the car five times. Other protestors fired at the vehicle, but Foster did not fire his weapon. Perry’s defense said he tried to avoid the incident and pointed out that the group surrounded his car.

His lawyers also emphasized how cooperative Perry was, citing that he handed over his social media passwords and phone to the police without requiring them to have a warrant. Daniel Perry also spoke with 911 after the incident.
The prosecution claimed Perry sped into the crowd, but science disproved that theory. They also ignored video footage of Foster boasting about his AK-47. There was no evidence to determine whether Foster raised his gun and pointed it at Perry. Then, the prosecutors said he had other options that night, such as driving away.

Another thing the prosecution brought up was his social media posts, which they say are evidence that he didn’t like protestors. One of his saying that you could shoot them in Texas did not help his case.
