A parking garage attendant in Manhattan has been charged with violating the law, including criminal possession of a weapon, assault, and attempted murder, for confronting an alleged thief.

According to Fox News, 57-year-old Moussa Diarra was charged after wrestling the thief’s gun away from him and shooting the suspect.

The incident occurred on the West 31st Street garage’s second floor around 5:30 AM when Diarra discovered a man looking into cars. The garage attendant, suspecting the man of stealing, took him outside the garage and asked what was inside his bag. Rather than complying with the request, the suspect, later identified as 59-year-old Charles Rhodie, pulled a gun on Diarra.

A struggle for the gun ensued, and it went off, shooting Diarra in the stomach. He continued to try to wrest away the gun when it discharged again, nearly missing Diarra’s ear. The parking garage attendant then managed to turn the gun on the suspected thief, shooting him in the chest.

Late Saturday, police said Rhodie was also charged with violations, including assault, attempted murder, and criminal possession of a weapon. Charges against Diarra sparked outrage, and it was unclear if he would be prosecuted.

One person working near the parking garage could hardly believe the charges against Diarra, saying, “You are kidding. That’s an April Fool’s Day joke, right?” Then he added, “How can a hardworking man get arrested for defending himself?”

The New York Post reports that a police officer, referring to the Manhattan District Attorney, commented on the attempted murder charge against the parking garage worker, “People like Alvin Bragg have made this city unsafe, and this worker is a victim defending himself.”

The New York Post also reported a family friend of the parking garage attendant said, “That’s self-defense. The guy tried to rob his business. He’s there for security. That’s literally his job, to defend his business. He takes his job seriously. Attempted murder charge has no place there. He [Rhodie] came to find him at his job with his gun; he [Diarra] has to defend himself.”

Both Rhodie and Moussa live in Manhattan. After the incident, they were taken to Bellevue Hospital in stable condition.
