This change, which came into effect immediately, was detailed in a press release issued on Friday by U.S. Citizenship and Immigration Services (USCIS). The policy change was made in response to feedback from the public and stakeholders as part of President Biden's Executive Order 14012, which aims to restore faith in the legal immigration system and promote integration and inclusion for new Americans.
The only gender markers currently available are "Male" or "Female," but DHS is actively working on introducing an additional marker ("X") for those with another or unspecified gender identity. In its press release, DHS stated that this update to the policy should reduce burdens and eliminate barriers for applicants and petitioners.

The announcement coincided with President Biden's statement to mark Transgender Day of Visibility. He condemned "MAGA extremists" advancing state laws to target transgender people and their families. "Let me be clear: These attacks are un-American and must end. The bullying, discrimination, and political attacks that trans kids face have exacerbated our national mental health crisis," he added. "More than half of transgender youth say they have seriously considered suicide. Loving parents are terrified for their children’s futures."

He reminded transgender Americans that they deserve safety and support in their communities and that no one should have to be brave just to be themselves. Biden urged transgender young people to call the national suicide prevention and crisis hotline at 988 and press "3" to speak with a counselor trained to support LGBTQI+ youth.

He concluded his statement by emphasizing the importance of love, dignity, and respect for transgender people and their value to our society. "I want every member of the trans community to know that we see you. You’re each made in the image of God, and deserve love, dignity, and respect. You make America stronger, and we’re with you."
The announcement also follows a Nashville shooting that killed six people, including three children, and was perpetrated by a 28-year-old transgender person.
