Fox News reports 40 House Democrats have stepped back to 1860 to draw on a constitutional amendment to bar Donald Trump from running for public office.

The Amendment adopted in 1860 was created to bar Confederates from holding public office. The Democrats have plans to unite and use the 14th Amendment to keep Trump out of public office.

On Thursday, Democrat Rep. David Cicilline of Rhode Island introduced legislation along with 40 co-sponsors to invoke Section 3 of the 14th Amendment.

The Amendment states that “No person shall...hold any office, civil or military, under the United States...who, having previously taken an oath, as a member of Congress, or as an officer of the United States..to support the Constitution of the United States, shall have engaged in insurrection or rebellion against the same, or given aid or comfort to the enemies thereof.”

The Democrats argue that Trump allegedly incited an insurrection on January 6, 2021, against the country, and the language in the 14th Amendment applies to him.

Cicilline said, “Donald Trump very clearly engaged in an insurrection on January 6, 2021, with the intention of overturning the lawful and fair results of the 2020 election. You don’t get to lead a government you tried to destroy.”

The Democrats say the legislation they are introducing “details testimony and evidence” the Select Committee collected makes the case that Trump was involved by helping to plan and encouraging the insurrection.

Trump announced his plan to run for President in 2024 last month at his Mar-a-Lago home. He told supporters, “America’s comeback starts right now.” He did not talk about the two impeachment trials, but he did present himself to be a “victim” of the “festering rot and corruption of Washington, DC.”

It's unclear whether the Democrats have plans to schedule a vote on the proposed bill before the current session ends.
