Big Win For Law And Order: Judge STOPS Biden From Ending "Remain In Mexico" Policy

Breitbart is reporting on a significant win for law and order after a north Texas judge ruled that the Trump-era “Remain in Mexico” policy cannot simply be abandoned because the Biden Administration wants it to.

Judge Matthew Kacsmaryk intervened to block the cancelation of this policy. This will set the stage for a major court battle between the Biden Administration and those trying to defend the “Remain in Mexico” policy.

The formal name for this policy is the Migrant Protection Protocol, as detailed by the Department of Homeland Security (DHS). The purpose of the policy is meant to return suspected illegal immigrants to return them to their country of origin while they await hearings related to their immigration status. The point is to try to keep people who are not legally permitted to be in the country from remaining here for a long time.

This decision comes after the U.S. Supreme Court ruled that the Biden Administration did NOT violate the Immigration and Nationality Act when it decided to try to end the Remain in Mexico policy.

That said, the Supreme Court left the door open for a lower court to overrule the decision, which is exactly what this judge has done.

The decision will stay a Biden Administration memo that would suspend the policy: “until the Court can resolve the merits of Plaintiffs’ claims.”

Breitbart reports that Texas Attorney General Ken Paxton is the one leading the charge against the policy change, and he praised the decision made by Judge Kacsmaryk in this decision.

Paxton tweeted the following:

“I sued Biden nearly 2 yrs. ago to keep Remain-in-Mexico. The Admin played games all the way to SCOTUS, but tonight Texas & USA WINS,”

and

“I just secured an order from a federal court ordering Biden not to scrap the program. Biden’s open-border agenda won’t survive my legal attacks.”

This policy may become a significant issue in the 2024 Presidential contest as it is still likely to be moving through the courts at that time. Those who believe in the policy may be likely to vote based on it and decide to cast a ballot for the candidate they believe will keep the policy in place.

The Supreme Court may intervene in the situation again if it is only partially settled before then.
