Liberal Justice Sides With Religious University To Block LGBTQ+ Club

The United States Supreme Court has ruled that a ruling by a New York judge must be temporarily blocked. The original ruling forced Yeshiva University to recognize an LGBTQ+ organization on campus.

Justice Sonya Sotomeyer, typically a left-leaning judge, signed the order that overturned the original order put out by the New York judge. She signed it as she is considered the Second Circuit judge for the area, including New York.

Eric Baxter, vice president and senior counsel at Becket, issued a statement in which he stated that a college campus such as Yeshiva University shouldn't have to go all the way to the Supreme Court to protect its First Amendment rights.

He did add that they were grateful that Justice Sotomeyer also stepped in to protect the rights of the UniversityUniversity.

This University has been working on fighting for its religious rights in the state of New York for more than a year at that point. It has been battling the YU Pride Alliance v. Yeshiva University case. Lower courts in New York agreed with the plaintiffs in the case and stated that Yeshiva University needed to recognize the LGBTQ+ group on campus.

However, the emergency order issued by Sotomeyer will allow the University to deny recognition of the group for the time being. This doesn't necessarily mean it will be the Supreme Court's final decision on the issue.

The University appealed to the Supreme Court for an emergency order because it would not be able to honor its traditions as a Jewish University and also allow for the recognition of LGBTQ+ groups on campus. The two things fly in the face of one another as far as Yeshiva University is concerned.

Yeshiva University opened its doors to students in 1886 and is considered one of the oldest Orthodox Jewish universities in the country.

The emergency appeal stated that being forced to recognize the LGBTQ+ group would be an unprecedented violation of its religious liberties.
