Justice Gorsuch: Report Into Leaked Draft Opinion Will Be Released Soon

This investigation seeks to discover more information about how the May decision regarding Roe v. Wade made its way to a media source.

Gorsuch explained that “the Chief Justice appointed a committee to oversee the investigation,” and the Court and its appointed Justices are looking forward to hearing the outcome of the ordeal. Like some of the other Justices, Gorsuch shares a similar opinion. He believes that the information leaked to the public had the potential to influence the result of the Court’s decision.

Gorsuch clarified how he believes these situations and the effort to influence Court decisions when he stated that these situations are frustrating for the Court in that they “inhibit our capacity to communicate with one another.” It’s apparent that while remaining calm and diplomatic, Gorsuch is deeply affected by the whole affair.

Gorsuch isn’t the only Justice with an opinion on this matter either. Judge Clarence Thomas commented on the affair at a May event in Dallas this year. The privileges and sanctity are holy, and the implied belief is “gone forever.”

Gorsuch attempted to spin this ordeal into something more positive and discussed how his affiliation with Justice Sotomayer is helping to promote civics education. His approach seems to be in hopes that providing education to more individuals will help prevent future incidents like this.

Gorsuch used the opportunity to deflect away from the investigation and discuss law school and civics education in the US versus elsewhere. He pointed out that in American law, students attend twice as much school as their British counterparts.

Gorsuch makes it known that he is just as committed to the causes that law students support as he is to the investigation into who leaked Supreme Court documents.
