Rep. Ilhan Omar revived criticism against the Supreme Court for the conclusion to overturn Roe v. Wade last month, condemning the court and anti-abortion Republicans as “extremists.”

Omar’s objection comes in response to the House passing legislation that would codify abortion rights and protect reproductive rights after the court reversed the 1973 decision that legalized abortion nationwide. The bill, nevertheless, is likely doomed in the 50-50 Senate.

“Grateful to everyone helping us fight against extremists who want to control every aspect of our lives,” Omar said in a tweet. “Freedom is a cornerstone of our country and we won’t go back.”

The House on Friday passed the Women’s Health Protection Act, a comprehensive abortion rights bill that had already been passed by the chamber this Congress. Congress had previously picked up the legislation, but lawmakers restored their endeavor to consider the bill after the Supreme Court overturned Roe v. Wade in June.

Speaker Nancy Pelosi touted the House’s second passage of the same bill this Congress and argued the matter is an election issue to pass the bill in the Senate.

“We must ensure that the American people remember in November because with two more Democratic senators, we will be able to eliminate the filibuster regarding a woman’s right to choose and make reproductive freedom the law of the land,” Pelosi said.

Proponents of the bill say it codifies the standards previously set by Roe into law. Still, opponents say it would go beyond by undoing state-level restrictions that the courts had previously upheld.

The bill, which passed the House on Friday with a 219-210 vote, was considered by Congress in February. Nevertheless, it failed to gain traction in the Senate as it was unable to surpass the 60-vote threshold needed to clear the chamber’s filibuster for a vote.

Rep. Chris Smith (R-NJ), a longtime abortion opponent in the House, said in remarks on the House floor that the bill “is far beyond the American mainstream and far beyond Roe v. Wade.”

The bill, passed by the House last year, failed in the Senate in February, as it could not clear the chamber’s 60-vote filibuster threshold during a procedural vote to proceed to debate, failing 46-48.

Sen. Joe Manchin (D-WV), who deems himself personally anti-abortion but supported the legal standard set by Roe, broke ranks with his party to oppose the bill, arguing it went beyond Roe.

Even if Manchin were to change his position on the bill, however, in the absence of Roe, both he and Sen. Kyrsten Sinema (D-AZ) have repeated since the Dobbs ruling that they remain against removing the filibuster, leaving the bill with no path forward to pass in the Senate, where it failed to earn even a majority.
