According to The Post Millennial, the subcommittee's Chairman, Brad Wenstrup, penned a letter to Attorney General Merrick Garland, outlining the reasons for this referral. The letter stated that the subcommittee was investigating how New York State had implemented federal guidance to protect nursing home residents and other long-term care facility occupants. The guidance in question was issued by the US Centers for Medicare and Medicaid Services and the US Centers for Disease Control and Prevention.

The investigation included a transcribed interview with Cuomo conducted on June 11. The subcommittee believes that during this interview, Cuomo made false statements regarding his involvement in and knowledge of a report issued on July 6, 2020. The report, titled "Factors Associated with Nursing Home Infections and Fatalities in New York State During the COVID-19 Global Health Crisis," was produced by the New York State Department of Health.

The letter from the subcommittee further stated, "Mr. Cuomo made multiple criminally false statements, including that he was neither involved in the drafting nor the review of the July 6 Report. Documents establish that statement to be false." The letter also pointed out that Cuomo testified he had no discussions about the report being peer-reviewed, a claim contradicted by documents. Furthermore, Cuomo's assertion that he was unaware if the report was reviewed by individuals outside the New York State Department of Health was also proven false by documents.

It urged the Department of Justice to consider Cuomo's alleged prior wrongful conduct when deciding whether to charge him for the false statements outlined in the attached referral.
