New York's Court Of Appeals Rejects Trump's Quest To Stop Letitia James' Witch Hunt

New York’s highest court on Tuesday dismissed former President Donald Trump’s last-ditch endeavor to avoid testifying in the state attorney general’s civil probe into his business practices, paving the way for his testimony next month.

The state’s Court of Appeals said there was no “substantial constitutional question” that would earn its intervention in the matter following an intermediate appellate court’s ruling last month enforcing a subpoena for Trump’s testimony.

The court also dismissed a motion by Trump’s lawyers to visit the subpoenas, saying that doing so would be “academic” since it wasn’t taking up the former President’s appeal in the first place.

Trump and his two eldest children, Ivanka and Donald Trump Jr. decided last week to field questions under oath starting July 15 unless the Court of Appeals agreed to step in.

A message looking for comment on Tuesday’s ruling was sent to Trump’s lawyer. Alan Futerfas, a lawyer for Ivanka and Donald Trump Jr., refused to comment. A message was also left with a spokesperson for Attorney General Letitia James.

The appellate division of the state’s trial court ruled on May 26 that the Trumps had to experience a deposition, supporting a lower court’s ruling that James’ office had “the clear right” to challenge Trump and certain other figures in his company, the Trump Organization.

James has said her three-year investigation has discovered evidence that the Trump Organization overstated the value of assets, including skyscrapers, golf courses, and even his Manhattan penthouse, to get loans, insurance, and tax breaks for land donations.

A lawyer for her office told a judge last month that evidence would support legal action against the former President, his company, or both, though the attorney said no decision had been made. Trump has condemned the investigation as part of a politically motivated “witch hunt” against him.

“It's my duty to investigate allegations of fraud or potential misconduct in New York. This incident is no exception,” she said.

Her tweet did not otherwise specify which “incident" she was referring to. However, the panel released new information about the extent of the Trump camp’s fundraising haul pegged to the President’s election fraud claims, which former campaign and government officials repeatedly undermined in their testimony.

Former Attorney General Bill Barr called them "bulls****."

The board said its investigators found Trump raised $250 million for his election “defense" fund, but just a tiny bit went to fight to raise election claims in court. Rep. Zoe Lofgren (D-Calif.), a committee member who also served as an impeachment manager, called it the “big rip-off” of small donors who contributed.
