Setting The Record Straight: Kristi Noem Bans Critical Race Theory In Schools

After South Dakota Legislature failed to pass a similar bill during its 2022 legislative session, Gov. Kristi Noem took action to ensure Critical Race Theory will not be taught in South Dakota’s K-12 schools.

After signing the executive order Tuesday, Noem declared, “Political indoctrination has no place in our classrooms.”

“Our children will not be taught that they are racists or that they are victims, and they will not be compelled to feel responsible for the mistakes of their ancestors,” Noem stated. “We will guarantee that our students learn America’s true and honest history — that includes both our triumphs and our mistakes.” The executive order prevents schools from requiring employees or students to affirm or follow “inherently divisive concepts” and requests that the state’s secretary of education and its Department of Education reviews policies and materials to ensure such concepts are not included.

Noem outlined “inherently divisive concepts” to address “any ideas in violation of the Civil Rights Acts of 1964,” including the shunning of notions that any race, color, religion, sex, ethnicity, or national origin are superior to another and are grounds for discrimination. The executive order also prohibits educational ideas that suggest people’s character, or that of their ancestors, is determined by their race, color, religion, sex, ethnicity, or national origin.

On March 21, Noem signed a bill prohibiting mandated Critical Race Theory training in higher education. “No student or teacher should have to endorse Critical Race Theory in order to attend, graduate from, or teach at our public universities,” Noem declared at the signing of H.B. 1012. “College should remain a place where freedom of thought and expression are encouraged, not stifled by political agendas.”

Noem also signed 11 other education bills that include provisions for several campus construction projects and the purchasing of digital media and health sciences equipment.

•    SB 42 authorizes the Board of Regents to contract for the design and construction of an addition to the wellness center at the University of South Dakota and makes an appropriation therefor.
•    SB 43 authorizes the Board of Regents to contract for the design, renovation, and construction of an addition for a health sciences center at Black Hills State University–Rapid City and makes an appropriation therefor.
•    SB 61 makes an appropriation to the Board of Technical Education to support the purchase of simulation equipment for a health sciences clinical simulation center on the campus of Southeast Technical College.
•    SB 95 revises provisions regarding the Teacher Compensation Review Board.
•    SB 132 makes an appropriation for multi-media lab equipment at Black Hills State University.
•    HB 1031makes an appropriation to the Board of Technical Education to construct an advanced manufacturing laboratory space and classrooms on the campus of Lake Area Technical College.
•    HB 1032 makes an appropriation to the Board of Technical Education to construct an agriculture and diesel power laboratory and multi-purpose space on the campus of Mitchell Technical College.
•    HB 1119 revises the general state aid formula to provide adjustment for alternative education students participating in interscholastic activities.
