Dustin Hice sued Lemon in 2019, saying the host assaulted him in a bar in the Hamptons, New York, a year earlier. Hice insisted Lemon put his hand down his own pants, touched himself, and then shoved his hand in Hice's face.
"Anybody that acts like that in public without any fear of what it might do to somebody or the consequences it might have, that's a pattern," Hice told Megyn Kelly on Monday.
Lemon has denied the claim.
"I wouldn't be surprised," Hice said. "He's protected by the fact that he's African American, [a] gay man on television, and I'm just some nobody."

Hice's lawsuit described an encounter in 2018 at a bar in Sag Harbor. After trying to buy Lemon a drink without success, Hice said the alleged assault transpired.

"About five or 10 minutes later, Don gets up, walks around the bar, comes up, right up to me and puts his hands down his board shorts," Hice said, according to the New York Post. "He rubs himself aggressively, his penis and whatever else down there."

"Lemon then shoved his index and middle fingers in Plaintiff's mustache and under Plaintiff's nose," according to House's suit.
At the time of the 2019 lawsuit, a CNN spokesperson called Rice's actions "unsuccessful threats and demands for an exorbitant amount of money."

"The plaintiff in this lawsuit has previously displayed a pattern of contempt for CNN on his social media accounts," the spokesperson told USA Today in a statement.

Attorneys for Lemon have described a lengthy discovery process in court filings that saw Hice supposedly admit to erasing numerous social media posts. Lemon's legal team also said Hice indicated in texts to the key witness in the case that there could be a financial reward for testimony corroborating his story.

However, that witness, a friend who was at the bar with Hice, allegedly said in a deposition that he was not sure Lemon actually had any physical contact with Hice. Text messages revealed from a third witness during discovery showed Hice posing with Lemon in front of Lemon's home. The second photo in a recent court filing shows Hice and the key witness rolling on Lemon's driveway.

That witness, who didn't support Hice's version of events, was not put forth as a potential witness by Hice's attorneys, Lemon's court filings said.
Lemon's attorneys said in a court filing that Hice teased Lemon and "repeatedly yelled" across the bar but that the host declined.
