A patriotic tune could be heard, coming from Judge Bruce Schroeder's phone on Wednesday, smack in the middle of Kyle Rittenhouse's homicide trial.

The call interrupted Rittenhouse's lawyer as he was speaking on his client's behalf. The ring tone was Lee Greenwood’s "God Bless the U.S.A."

Schroeder, who appeared annoyed by the interruption, dismissed the call almost as soon as the ringer went off.

Greenwood, an award-winning country artist, performed at inaugural events for former President Donald Trump and other Republican presidents, and "God Bless the U.S.A." repeatedly blares over the speakers at Trump rallies.

Rittenhouse, 18, is accused of fatally shooting two people and injuring a third during a night of violent clashes in Kenosha, Wisconsin, in August 2020. Rittenhouse, who claims he was defending himself, has pleaded not guilty to seven charges, including two counts of homicide, one count of attempted homicide, and two counts of reckless endangerment with a deadly weapon.

At another point during the trial on Wednesday, Rittenhouse sobbed after he took the stand to be questioned by his defense team.

Gaige Grosskreutz, a protester and volunteer medic wounded on the streets of Kenosha by Rittenhouse, testified Monday he was pointing his gun at Rittenhouse before the teenager fired his rifle at him.

According to legal experts, Wisconsin prosecutors could be barred from re-trying Rittenhouse if a defense motion for a mistrial is granted and the court rules that prosecutors intentionally caused the mistrial.

Lawyers for Rittenhouse asked for a mistrial Wednesday over the line of questioning directed at their client, which prompted Circuit Judge Bruce Schroeder to lash out at the chief prosecutor angrily. He did not rule on the motion.

Kenosha County Assistant District Attorney Thomas Binger was cross-examining Rittenhouse. Binger asked Rittenhouse about his silence after his arrest and the use of deadly force to protect property.

"I was astonished when you began your examination by commenting on the defendant’s post-arrest silence," Schroeder told Binger after the jury was ushered out of the courtroom. "That's basic law. It's been basic law in this country for 40 years, 50 years. I have no idea why you would do something like that. You know very well that an attorney can't go into these types of areas when the judge has already ruled without asking outside the presence of the jury to do so. So don't give me that. That's number one."

Following the contentious exchange, defense lawyers made the mistrial request.
