Did Ketanji Brown Jackson Just Trigger A Supreme Court Ethics Showdown?

Sen. Marsha Blackburn, R-Tenn., is pressing Chief Justice John Roberts to open a formal inquiry into Supreme Court Justice Ketanji Brown Jackson’s appearance at last month’s Grammy Awards, arguing that the justice’s participation calls her impartiality into doubt.

According to Newsmax, Blackburn set out her concerns in a letter sent Thursday to Roberts, asking him to determine whether Jackson’s attendance at the high-profile entertainment event complied with the Supreme Court’s recently adopted Code of Conduct. The Tennessee Republican contends that the justice’s decision to attend a ceremony saturated with left-wing political messaging risks eroding public confidence in the Court at a time when its legitimacy is already under sustained attack from the left.

Jackson was at the Grammys as a nominee in the best audio book, narration and storytelling category for her memoir, "Lovely One," a personal project that has drawn significant media attention since her confirmation. Blackburn, who sits on the Senate Judiciary Committee, did not focus on the literary merits of the memoir but instead on the overt political content that dominated portions of the broadcast and the justice’s visible reaction to it.

In her letter, Blackburn cited what she described as "far-left rhetoric" promoted during the show, including jokes and statements aimed squarely at Immigration and Customs Enforcement (ICE).

She highlighted that Jackson appeared to applaud after some of those remarks, behavior Blackburn argues is inconsistent with the obligation of a Supreme Court justice to remain above partisan theatrics.

"While it is by no means unheard of or unusual for a Supreme Court justice to attend a public function, very rarely — if ever — have justices of our nation's highest Court been present at an event at which attendees have amplified such far-left rhetoric," Blackburn wrote. For conservatives already wary of the Court’s left flank, the Grammys episode reinforces concerns that progressive justices are increasingly comfortable aligning themselves with cultural institutions openly hostile to law enforcement and border security.

Blackburn is urging Roberts to evaluate Jackson’s conduct under the Court’s own ethics rules, which require justices to "act at all times in a manner that promotes public confidence in the integrity and impartiality of the judiciary." Those rules, adopted in 2023 after a coordinated campaign by Democrats and liberal activists targeting conservative justices, were intended to reassure the public that all nine members of the Court are bound by clear standards of behavior.

The Supreme Court’s first formal code of conduct, signed by every justice, came in the wake of relentless media scrutiny over alleged ethics lapses involving several conservatives, including Justice Clarence Thomas and Justice Samuel Alito. Conservatives have long argued that much of that scrutiny was politically motivated, designed less to protect judicial integrity than to intimidate right-leaning justices and delegitimize decisions that frustrate progressive policy goals.

The stakes surrounding Jackson’s public image are heightened by the Court’s current docket, which includes cases tied to President Donald Trump and contentious disputes over birthright citizenship. The Court is also expected to hear additional immigration-related cases in the near future, making any perceived bias on questions of border enforcement or national sovereignty especially troubling to those who favor a strict reading of immigration law.

At the Grammys, political signaling on immigration was unmistakable, with some attendees wearing "ICE Out" pins and performers unleashing profanity-laced tirades against immigration enforcement.

Statements such as "No one is illegal on stolen land" and "[Expletive] ICE" were broadcast to millions of viewers, and, notably, delivered in the presence of a sitting Supreme Court justice whose Court will rule on precisely these kinds of issues.

For many conservatives, the spectacle underscored the deepening alliance between progressive politics and the entertainment industry, where hostility to ICE and border security has become a fashionable virtue signal. Blackburn’s concern is that when a justice appears to endorse or celebrate such rhetoric, it blurs the line between neutral adjudicator and ideological ally of the cultural left.

"Americans deserve a Supreme Court that is impartial and above political influence. When a Justice participates in such a highly politicized event, it raises ethical questions," Blackburn said in a post on X. Her message reflects a broader conservative belief that the judiciary must resist the pull of celebrity culture and partisan activism if it is to remain a credible check on both the administrative state and the progressive cultural agenda.

Blackburn also reminded Roberts that Democrats have not hesitated to demand recusals and investigations when the justices under fire are conservatives. She pointed to Sens. Dick Durbin, D-Ill., and Sheldon Whitehouse, D-R.I., who previously pressed Roberts to encourage Justice Samuel Alito to step aside from election-related cases over a flag flown at his home — a request Alito firmly rejected.

By invoking that episode, Blackburn is effectively challenging Roberts and the broader legal establishment to apply the same standards to a liberal justice that have been aggressively wielded against conservatives. She further contrasted Jackson's situation with controversies involving Justice Clarence Thomas, arguing that unlike what she called "meritless claims" against conservative justices, Jackson's appearance raises "serious questions" about judicial neutrality.

For many on the right, the Grammys controversy is not merely about one night in Hollywood but about whether the Court will hold its liberal members to the same ethical expectations that have been used to hound its conservative bloc.

As the Court prepares to weigh in on immigration, executive power, and Trump-related disputes, Blackburn’s challenge to Roberts underscores a central conservative concern: that the judiciary must remain insulated from the pressures of progressive pop culture and partisan activism if it is to command the respect of a deeply divided nation.
