An octogenarian from Long Island has found himself in legal trouble, accused of inflicting significant damage on a fleet of Tesla vehicles.

The alleged incident, which took place at the Roosevelt Field Mall, has resulted in charges of criminal mischief against 83-year-old Victor Divergilio. The damages, reportedly amounting to $23,000, were said to have been caused by Divergilio using a key to scratch five Teslas. The case has drawn attention not only for the alleged act but also for Divergilio's vehement remarks about Tesla's CEO, Elon Musk, and President Donald Trump.

According to Breitbart, Divergilio's confrontation with law enforcement was marked by a denial of the accusations, despite video evidence presented to him. He reportedly stated, “Yeah, that’s me but I wasn’t keying any cars. Yea but I was getting my keys because I had just paid and I wanted to see how much money I had.”

However, the criminal complaint highlights a more aggressive side, with Divergilio allegedly expressing, “Musk owns Tesla yea, he’s getting thrown out at the end of the month. He should die alright so should Trump fucking die.” These statements reflect a deep-seated animosity towards both Musk and President Trump, which Divergilio later attempted to downplay in a phone interview.

In his conversation with the New York Post, Divergilio denied the allegations, suggesting a misunderstanding had occurred. He remarked, “If I did something against him, it wouldn’t be simply scratching their cars,” referring to Musk. Despite admitting his dislike for the billionaire, Divergilio insisted, “Well, I don’t like him but I would never do that.” His comments suggest a complex relationship with the figures he criticized, particularly given Musk's association with the Trump administration's efforts to streamline government operations.

Following his arraignment in Nassau County Criminal Court, Divergilio was ordered to undergo a mental health evaluation and subsequently released. He is scheduled to return to court on April 30.

Divergilio, who identifies as a Vietnam veteran with PTSD, continues to assert his innocence. “I didn’t do what they said. I just spent a horrible night in jail like a criminal,” he told the Post. “I walked through and they say I scratched the cars.” This case raises questions about the intersection of mental health, veteran affairs, and the legal system, as Divergilio prepares to face further legal proceedings.
