The Democrats have criticized the probe as a "reckless insult" to Spain, a key U.S. ally, and have urged the Federal Maritime Commission (FMC) to suspend the investigation immediately.
According to Fox News, the three lawmakers penned a letter to the FMC, an independent agency responsible for regulating maritime trade that impacts the U.S., expressing their disapproval of the investigation into Spain's refusal to allow entry to ships carrying weapons for Israel. They described the investigation as an affront to Spain's sovereignty and its commitment to uphold international law, including its treaty obligations to prevent genocide.

The lawmakers' letter stated, "This investigation is a reckless insult to our allies in Spain, which has only sought to enforce in good faith its sovereign national policies and uphold international law, including its treaty obligations to prevent genocide." They further added, "It is bad enough that the United States is violating these same obligations and its own domestic laws by sending these weapons. We urge you to immediately suspend this obstruction of justice and withdraw this misguided investigation."

Spain, a longstanding U.S. ally and NATO member, announced it would cease selling weapons to Israel following the outbreak of war with Hamas in October 2023. Since then, Spain has been accused on three separate occasions of denying docking privileges to ships allegedly carrying weapons for Israel. Spanish Foreign Minister Jose Manuel Albares confirmed one such incident in May, stating on state TV channel RTVE, "The Middle East needs peace. That is why this first denial of authorization will start a policy for any boat carrying arms to Israel that wants to dock at a Spanish port."

The FMC initiated its investigation earlier this month after receiving reports that Spain had denied entry to certain vessels on at least three separate occasions this year. The agency's investigation aims to determine whether foreign government regulations or practices result in unfavorable conditions for U.S. shipping in foreign trade.

However, the House Democrats defended Spain's actions, arguing that the country's decisions to bar two Maersk vessels from docking at its port in Algeciras in early November, and to deny port of call to the Marianne Danica at the port of Cartegena in May, were legitimate actions taken by a sovereign state to ensure compliance with international human rights and humanitarian law.

The three House Democrats have frequently accused the Biden administration of improperly acquiescing to Israel, the U.S.'s closest ally in the Middle East. They also argued that the U.S. has no standing to investigate Spain's decision, claiming that these actions do not threaten the reliable international ocean transportation supply system that the FMC is tasked with safeguarding.

The lawmakers concluded their letter by stating, "No agency of the United States should be in the business of punishing or sanctioning our allies for enforcing the international law that our government has refused to uphold." Earlier this year, Spain, along with Ireland and Norway, formally recognized Palestinian statehood.
