Tenured Professor's Future In Jeopardy After Adult Film Revelation: Free Speech Or Unethical?

In a case that has drawn considerable attention due to its implications for First Amendment rights, Joe Gow, a former chancellor of the University of Wisconsin-La Crosse campus, is fighting to retain his tenured teaching position.

Gow was dismissed from his chancellor role after it was discovered that he had been involved in the production of adult films with his wife.

Gow, who had held the chancellor position for almost 17 years, made his case before a personnel committee of the University of Wisconsin Board of Regents. He is currently on paid leave from his faculty position, a status he has maintained since his dismissal as chancellor in 2023, following the discovery of the explicit videos on adult websites.

University attorney Wade Harrison presented a strong case against Gow, stating that his actions were "unethical, hypocritical and unacceptable." Harrison went on to say, "Enough is enough. Dr. Joe needs to go."

According to The New York Post, a faculty committee from UW-La Crosse unanimously recommended in July that Gow should be stripped of his faculty position. They argued that he had exploited his position to generate more interest and revenue from the videos. University attorneys further argued that Gow's actions had tarnished the university's reputation and disrupted its mission.

The attorneys also contended that Gow had demonstrated an inability to recognize his own poor judgment. The regents personnel committee discussed the case privately after hearing testimonies on Friday. Their confidential recommendation will be presented at a meeting of the full Board of Regents as early as next week.

The case has sparked national interest due to the scandalous nature of a high-ranking university official producing adult films and the subsequent debate on free speech rights. Gow defended his actions, arguing that his videos and two e-books he and his wife, Carmen, have published about their experiences in the adult film industry are protected by the First Amendment.

Gow's attorney, Mark Leitner, argued, “You don’t need the First Amendment to protect ‘The Star Spangled Banner.' You don’t need the First Amendment to protect easy and comforting speech. It’s exactly the opposite. We need the First Amendment precisely when the danger of stifling, controversial, unpopular speech is at its highest. And that’s what we have here.”

However, Harrison countered that while the videos are legal, they are not protected speech under Gow's employment contract. He stated, “Gow’s pornography videos are not protected by the First Amendment."

The university is seeking to terminate Gow's employment on grounds of unethical conduct, insubordination for refusing to cooperate with an investigation, and violation of computer policies. The UW-La Crosse employee handbook stipulates that faculty must "exhibit a level of behavior supporting the university mission."

Gow has consistently maintained that he and his wife produced the adult content during their personal time, and that neither the videos nor the books mentioned UW-La Crosse or his role at the university.

Despite this, Gow faced criticism in 2018 for inviting adult film actress Nina Hartley to speak on campus, a decision made after filming an adult video with her. The university paid Hartley $5,000 from student fees for her appearance.

Gow and his wife have also published e-books under pseudonyms, titled "Monogamy with Benefits: How Porn Enriches Our Relationship" and "Married with Benefits — Our Real-Life Adult Industry Adventures." They also host a YouTube channel called "Sexy Healthy Cooking," where they cook meals with adult film actors.

Gow's aspiration to return to teaching is met with opposition from his department chair, Linda Dickmeyer. She expressed concerns about Gow's return to teaching, given that he has not taught for 20 years. Despite the controversy surrounding Gow's actions, the final decision on his future at the university remains in the hands of the Board of Regents.
