According to The New York Post, Mike Howell, the executive director of The Oversight Project, which is affiliated with the Heritage Foundation, has legally requested emails between NASA political appointees and the White House, including the office of Vice President Harris. The lawsuit also seeks access to outgoing emails to Harris' presidential campaign. Howell has raised concerns about the decision to extend the stay of astronauts Butch Wilmore and Sunita Williams at the ISS, suggesting a possible political motive behind the move.

"This looks like to me and other experts that Kamala Harris, the space czar, chose politics over our astronauts," Howell stated. He further criticized the mainstream media for their apparent lack of interest in this "massive scandal," vowing to continue the investigation to provide Americans with the answers they deserve.

The National Space Council (NSpC), which Harris chairs, was originally organized under former President George H.W. Bush, disbanded, and then reorganized under former President Trump. Trump also unveiled the U.S. Space Force, the first new branch of the military in decades, at a 2018 NSpC meeting.

The Oversight Project's lawsuit aims to compel NASA to share correspondence from agency chief of staff Bale Dalton III, Associate Administrator James Free, and five other senior officials. It also seeks communications between NASA and officials in the commercial crew program at Boeing, the company that manufactured the Starliner capsule that transported Wilmore and Williams to the ISS.

A source close to the matter highlighted the responsibilities of the NSpC chair, as outlined by Trump in his 2021 executive order establishing the council. The chair serves as the President's principal advisor on national space policy and strategy, giving them substantial advisory authority over NASA's decision-making.
In August, a NASA official acknowledged a "little disagreement in terms of the level of risk" between the agency and Boeing after the Starliner capsule experienced propulsion issues and elemental leaks. Despite these issues, the Starliner craft safely returned to Earth unmanned on Sept. 7. Boeing officials expressed confidence in Starliner's ability to return safely with crew aboard, stating, "We continue to support NASA's requests for additional testing, data, analysis and reviews to affirm the spacecraft's safe undocking and landing capabilities."

Howell has also raised concerns about the qualifications of some NASA hires made during Harris's tenure as NSpC chair. He criticized the appointment of individuals with backgrounds in areas such as political science and music, arguing that "Space is serious business. Kamala Harris obviously has no business running the National Space Council… They're lost in space right now."
Howell further criticized Harris's record as both Border Czar and Space Czar, arguing that the public needs to see any political correspondence between NASA, the vice president's camp, and/or Boeing. He suggested that other nations like China are watching for such "sign[s] of weakness."

Despite the controversy, the astronauts have taken their extended stay in stride. "I love being in space. This is my happy place," Williams said. Wilmore, who will miss his daughter's final year of high school, has requested his absentee ballot so that he can vote from orbit.

When Fox News Digital reached out to Harris' governmental office and the Harris campaign, they did not receive a response. However, a NASA spokesperson stated that Harris and NSpC staff "received frequent updates on the Starliner Crewed Flight Test." The spokesperson clarified that while the NSpC works closely with civil, national security, commercial, and international partners to advance the nation's space priorities, it does not make operational spaceflight safety recommendations or decisions. This statement leaves open the question of who ultimately bears responsibility for the extended stay of the astronauts and the potential political implications of this decision.
