A Colombian national, accused of sexually assaulting a minor, has been apprehended for the second time by Boston's Enforcement and Removal Operations (ERO) after local authorities failed to enforce his immigration detainer.

The arrest was announced in a press statement on Wednesday, following his capture on March 28 in Lynn, Massachusetts.

The individual, whose identity remains undisclosed, faces local charges of "rape and indecent assault and battery of a minor over the age of 14." ERO Boston Field Office Director Todd M. Lyons expressed his dismay over the allegations, stating, "This unlawfully present Colombian national stands accused of a horrific crime. There are few crimes more disturbing than the sexual assault of a child, and no person more disturbing than one who would prey upon the most innocent members of our communities."

Lyons further pledged ERO Boston's commitment to public safety, vowing to "continue to prioritize public safety by working tenaciously to arrest and remove unlawfully present child sex predators from our New England neighborhoods.”

The Colombian national's journey in the United States began with his illegal entry, followed by his arrest by U.S. Border Patrol agents in Eagle Pass, Texas, on July 3, 2022. The migrant was subsequently enrolled in an "Alternatives to Detention program" by ERO officials, and a "noncitizen" notice was issued, requiring him to appear before a Department of Justice (DOJ) immigration judge.

However, the narrative took a turn in January when the migrant was arrested by Lynn, Massachusetts, authorities for alleged sex crimes against a minor. He was arraigned at the Lynn District Court on Jan. 29, and later that day, ERO Boston lodged an "immigration detainer against the Colombian national" with the district court. Unfortunately, the Essex County Sheriff’s Department did not honor the request.

Despite the pending sex charges against a minor, the migrant was released from state custody and was not arrested again until approximately two months later. The circumstances surrounding the time between his releases remain unclear. However, ERO authorities have since issued him a "superseding notice to appear before a DOJ immigration judge and a warrant for his arrest."

As he awaits his removal proceedings, the Colombian national will remain in U.S. Immigration and Customs Enforcement (ICE) custody.
