Second Amendment Triumphs In Virginia As Judge Decides AGAINST Handgun Ban For This Key Demographic

A Federal judge in Virginia struck down a gun law on Wednesday and upheld Second Amendment rights for young adults.

According to Fox News, U.S. District Court Judge Robert Payne wrote, “If the Court were to exclude 18-to-20-year-olds from the Second Amendment’s protection, it would impose limitations on the Second Amendment that do not exist with other constitutional guarantees.”

In the 71-page ruling, the judge cited how adults under 21 could legally vote, join the armed forces, and serve on a federal jury. There was no reason to impose a ban on them buying firearms.

He wrote in the ruling, “Because the statutes and regulations in question are not consistent with our Nation’s history and tradition, they, therefore, cannot stand.”

The landmark ruling for the Supreme Court’s Bruen decision, on which the judge heavily relied, has led to several successful challenges to gun laws that had been on the books for years. The judge referred to the Bruen ruling more than once, citing that the government did not present “any evidence of age-based restrictions on the purchase or sale of firearms from the colonial era, Founding or Early Republic.”

He wrote that the “Founders considered age-based regulations on the purchase of firearms to circumscribe the right to keep and bear arms confirmed by the Second Amendment.”

According to the lawsuit, John Corey Fraser, 20, was barred from purchasing a Glock 19x handgun from a licensed gun dealer. He and other plaintiffs showed the unconstitutionality of the Gun Control Act of 1968 and other regulations because they did not allow adults under the age of 21 to exercise “the right to keep and bear arms.”

Judge Payne’s ruling was a win for the plaintiffs and other young adults who chose to purchase firearms and exercise their Second Amendment rights.
