Lacey Purciful spoke with Fox News Digital and said her family called 911 five times after the March 18 crash. However, the understaffed police department could not respond to them nearly as quickly as they normally would.
The victim says that she, her husband, and their two children were driving down Jollyville Road in North Austin around 4 PM on the 18th when a driver crossed over two lanes of traffic and hit them head-on.
She told Fox News Digital the following:
“Head on didn’t hit the brakes, airbags deployed, screaming kids, smoke, adrenaline, we started screaming, and got the kids out of the car.”
The family quickly released that the other driver, a man in his 70s, was intoxicated by their estimation. The victims say that one of the first people to arrive at the scene was a bus driver, and that driver said that the man “smells like alcohol” and was “refusing to get out of the car.”

“He sat in the car for over 30 minutes, and then when he got out of the car, he fell to the ground and was making weird noises and [just] acting weird.”

According to the family, it took police officers approximately 2.5 hours to arrive. By the time they did, they had conducted a sobriety test on the suspect, but he passed the test at that time. The victims believe that the delay of 2.5 hours gave the suspect enough time to sober up while they all waited for police to arrive on the scene.

Purciful said:
“Everyone could smell alcohol on this man,” and “He openly admitted what he was drinking. He told my husband he was drinking High Noons. It isn’t just me making accusations; he was [just] straight-up coming out and telling us, and there was no remorse.”

She continued:
“He never asked if our children were OK. He never apologized. I have a video of him smiling at me as [I’m] calling him a drunk driver. He’s just standing there smiling at me.”
The family has retained personal injury attorney Adam Loewy to represent them. Loewy said that about 25 officers would typically be working in the area, but on that day, only about 5 officers were working there. That labor shortage was what might have caused the significant delays.
