Greene wrote a letter expressing her "profound dismay" over the DOJ's decision to press charges against Mackey for posting a meme on Twitter in 2016. The meme in question instructed voters on how to cast their ballots via text for the US presidential election, which Greene pointed out is not actually possible. Moreover, Greene argued that Mackey's charge is "a subset of the enforcement act of 1870, also known as the Ku Klux Klan Act."

According to Greene, the charge "is not only laughable but also a clear indication that the DOJ does not have a sound grasp on how to interpret the law." She further noted that this law is "intended to criminalize physical violence and intimidation used to prevent people from exercising their rights as outlined in the Constitution" and not for the sharing of memes on social media.

Greene suggested that the DOJ is "deliberately contorting this statute to apply to the free speech exercise by individuals with dissenting political views" and accused Garland of using "Soviet-style methods of enforcing the law" which are "better suited for the governments of China or Iran, not the United States of America."

Greene then called on Garland to order the DOJ to drop its charges against Douglas Mackey and "to immediately thereafter resign as Attorney General of the United States before your gross incompetence, and twisted sense of justice further deteriorates the rights enumerated in and protected by the Constitution and destroys the lives of more Americans."

She added on Twitter, "We’ve seen individuals charged with felonies for obstructing legal proceedings on January 6th, 2021, despite many cases being nonviolent protestors exercising their constitutional right to freedom of assembly, but this may be a new low."

The Trial was scheduled to start this week in NY, but Mackey’s attorneys requested a two-week delay when the Southern Poverty Law Center reportedly intimidated a witness into withdrawing his testimony. Greene's letter has brought into sharp focus the implications of the DOJ's actions on the fundamental right to free speech.

In this case, it appears that the DOJ is targeting an individual for simply expressing their views on a platform available to all. If allowed to stand, this may set a dangerous precedent for the curtailment of free speech.
