More Big Cases On The Way As Supreme Court Takes On Affirmative Action

The Supreme Court has already had a busy session with its rulings on gun laws and its historic overturning of Roe V.Wade. However, more big cases on the docket for the Supreme Court are coming up.

The Court will hear cases related to affirmative action regarding university admissions. Universities are currently permitted to consider race when considering who gets admitted. However, two Asian-American students say that this rule causes them to be discriminated against.

These students are part of a lawsuit the Students for Fair Admissions(SFFA) brought against the University of North Carolina and Harvard University. Both schools are said to have unfairly used race as a determining factor for admissions.

Asian American Advancing Justice (AAJC) President and CEO John C. Yang spoke at a national press conference about what he says is overwhelming support for affirmative action among Asian Americans.

Yang claimed that most Asian Americans support affirmative action, and polling seems to back up what he is saying. Polls have shown that 69% of Asian Americans believe in affirmative action.

He said that various courts have looked at the case that is to appear before the Supreme Court. He noted that district and appellate courts have all looked at the issue and have reached the same conclusion. He says they have ruled that there is no discrimination against Asian-American students in university admissions.

Interestingly, Harvard admissions data shows that approximately 28% of the recently admitted class was Asian-American. This is although Asians only make up about 7% of the population.

Yang said that the plaintiffs, in this case, are playing off the stereotype of Asian Americans as the “model minority” in this country. He says they have cherry-picked cases to get laws changed in the country.

Yang believes that if universities are no longer permitted to consider race as an admission factor, it will reduce racial diversity in the admissions process.

The percentage of African-American students admitted to Harvard could fall from 15% to 6%, and Latinx student populations could decrease from 12.6% to 9%, according to data from Yang.

Yang has a particular point of view on this matter but also comes up with interesting facts. It will be interesting to see what the Supreme Court has to say on the matter.
