A bill that was advanced in the California state legislature on Monday would designate the state as a sanctuary state for transgender kids and their parents.

The State Assembly approved the measure 48-16 without debate and has sent it to the State Senate for final approval before it goes to the Governor's desk

The point of the legislation is to provide safe refuge for parents who might have their children stripped away from them by other states based on laws in those states that may mandate such a thing happening following the laws of that state. Put another way. California may position itself as THE place for parents with transgender children if they fear another state will take children from them.

Democratic Sen. Scott Wiener was the one who proposed the measure after specific actions by GOP-controlled states like Tennessee, Texas, and Arkansas.

The state Senator said the following in a recently released statement:

"Trans kids and their parents are being criminalized and used as political punching bags by right-wing zealots,"

He continued:

"No one should ever have to worry about being separated from their child simply for allowing that child to be who they are."

Conservatives argue that the bill could shield parents using the idea that their child might be transgender as some pretext. The legislation is similar to another California bill that recently banned the prosecution of doctors who perform abortions within the state, even when their patients come from another state.

This transgender bill would seek to nullify the judgments of judges from other states who may rule that children need to be removed from the custody of parents who seek gender-affirming care for those children.

Brad Dacus, the president of the conservative nonprofit Pacific Justice Institute, has given his feelings about the measure, saying that it opens the door to the possibility that parents may bring their children to California under the guise of getting gender-affirming surgery. In his view, what they may choose to do instead is equal to the kidnappings of those children from conservative states.

He stated that it could:

"make California a haven for child abductors and predators." and "condone the taking of children from other states in violation of court orders."
