Steve Nikoui, a Gold Star father, was exonerated by Washington, DC Attorney General Brian Schwalb on Tuesday, following his arrest for heckling President Biden during the State of the Union address earlier this month.

Nikoui, 51, had been facing a misdemeanor charge of "crowding, obstructing or incommoding," which could have resulted in a $500 fine and a 90-day prison sentence.

As reported by Fox News, Schwalb reasoned that despite the Capitol Police's assertion that "disrupting the Congress and demonstrating in Congressional Buildings is illegal," Nikoui should not face charges, given that numerous other protestors in recent years have not been prosecuted.

Upon hearing the news of his exoneration, Nikoui was described as being "thrilled and humbled," with tears in his eyes by those present with him.

During the State of the Union address, Nikoui had shouted "Abbey Gate" and "13 Marines," referencing the location of the ISIS-K suicide bombing that claimed the lives of 170 Afghan civilians and 13 U.S. service members, including his son, Lance Corporal Kareem Nikoui.

Florida Representative Brian Mast criticized the arrest of his State of the Union guest, stating, "The Sergeant at Arms is holding my guest for yelling at POTUS in protest because his son was killed in action at the Abbey Gate due to Biden’s incompetence." He added, "So much for the right to petition our government for the redress of grievances."

Mast further expressed his discontent, stating, "To this day, no Biden official has been dismissed or demoted as a result of the deadly and catastrophic withdrawal from Afghanistan. I will not stop until the Biden Administration is HELD ACCOUNTABLE for its disastrous policies."

He also criticized President Biden for his failure to acknowledge the 13 U.S. service members who lost their lives during the Afghanistan withdrawal in his last three State of the Union speeches.
