Kaplan stated, “The statute of limitations for defamation in most jurisdictions is between one and three years. As we said after the last jury verdict, we continue to monitor every statement that Donald Trump makes about our client.”
This response comes following Trump's recent comment on CNBC where he dismissed Carroll's allegations as a "false accusation" and expressed confidence in winning the appeal. Trump remarked, “I have no idea who she is, except one thing, I got sued. From that point on I said, ‘Wow, that’s crazy, what this is.’ I got charged, I was given a false accusation and had to post a $91 million bond on a false accusation.”

Prior to the potential new lawsuit, Trump had already posted over $90 million in bond for the appeal of the previous defamation case. Carroll had accused Trump of raping her in a 2019 magazine article, although she struggled to recall specific details during the civil trial's cross-examination in 2023.
