Introduced by Rep. Matt Gaetz, R-Fla., the amendment, titled "prohibition on cannabis testing for enlistment or commission in certain armed forces," seeks to address the recruitment and retention crisis currently faced by the military.
Gaetz took to social media to express his support for the amendment, stating, "Our military is facing a recruitment and retention crisis unlike any other time in American history.
I do not believe that prior use of cannabis should exclude Americans from enlisting in the armed forces." He further emphasized the importance of embracing individuals who are willing to serve their country.
If passed, the proposed amendment would put an end to cannabis testing for military personnel both at the time of enlistment and when receiving a commission as an officer.

The amendment explicitly states that the Secretary of the military department concerned cannot require individuals to undergo cannabis testing as a condition for enlistment or commission in the Armed Forces.

The military has long maintained strict regulations regarding marijuana use among its servicemen. While President Biden granted pardons to thousands of Americans facing federal marijuana possession charges last year, this did not extend to members of the military.

Service members charged under military law for similar offenses were not eligible for the same benefit under the Uniform Code of Military Justice.
