Racial bias is the subject surrounding the New York City subway incident involving a former Marine and a homeless person.

According to Ben Shapiro, the Daily Wire Editor Emeritus, in an interview on Thursday, a lawyer said accusing Penny of racial bias was "baseless."

Penny stands accused of killing Jordan Neely on May 1 on a Manhattan subway. Neely was a homeless man who also had a violent criminal history. Penny pleaded not guilty to one count of negligent homicide and one count of second-degree manslaughter.

Attorney Tom Kenniff, who is representing Penny, told Shapiro during Thursday's podcast that the media was attempting to turn the incident into a racial issue because Penny is white, and Neely is black. Kenniff said it was "reckless, vitriolic speculation" and that Penny "doesn't have any racial animus."

Kenniff is confident that his client will be exonerated. The incident was instigated by Neely, according to witnesses on the subway, when he made threatening comments toward passengers in the subway car. Penny placed Neely in a chokehold to subdue him. Unfortunately, Neely died while being held down on the subway car floor.

The lawyer went on to say, "We have absolutely no doubt that, ultimately, our client will be exonerated. But, you know, the law recognizes, and we as a people should recognize, that the mere act of being the subject of a criminal prosecution, regardless of how it turns out, is a life-altering, traumatizing thing for anyone."

Neely has reportedly said he was ready to go to jail for life and that he was ready to die.

Kenniff told the Daily Wire, "Anyone who knows anything about the New York criminal justice system knows that there is only one way that one could go to prison for the rest of their life, and that's to take another life." "So that's the environment that my client was in, and this case is all about, you know, what he reasonably perceived and what a person in his situation would have reasonably perceived."

On June 14, an indictment was issued against Penny. New York officials have said the incident will be thoroughly investigated. Penny will be in court on September 25.
