On Wednesday, Congress approved a resolution overturning the protection of thousands of waterways put in place by the Biden administration.

Republicans call the expanded protections of wetlands, small streams, and other waterways an environmental overreach that harms farmers, businesses, and developers.

CBS News reports, “They used the Congressional Review Act that allows Congress to block recently enacted executive branch regulations. The Senate voted in favor 53 to 43 Wednesday to give final legislative approval to the measure. Four Democrats and independent Sen. Kyrsten Sinema of Arizona joined Republicans to vote in favor of the resolution.”

Democrat Joe Manchin calls the overreach unreal as he sides with Republicans on the controversial topic. Many Democrats, including Biden, have sided with environmental groups that want to protect as many waterways as possible. However, Republicans say the expanded protections have caused overreach, creating a burden on businesses.

Democratic Senator Jon Tester of Montana also sided with Republicans on the vote. According to Conservative Daily News, Tester said, “As a third-generation farmer, I know firsthand how important clean water is to Montana’s economy and the health of our communities.” He also said he had listened to ranchers and farmers from Montana and felt the rule was not in Montana’s best interests after hearing what they had to say. However, he didn’t wholly push back against a bill for clean water. Tester says that the Biden administration needs to return to the drawing board to get it right.

The President can still veto it. If that happens, the issue heads to the Supreme Court, where Republicans will prove that the bill gives environmental agencies like the EPA too much authority, resulting in government overreach.

Senate Republican Leader Mitch McConnel said in a statement, ‘If the President vetoes it, Americans will need to hope the Supreme Court makes it clear that these EPA bureaucrats are way outside the authority that Congress actually provided in the Clean Water Act.”
