In 2016 California enacted the law to respond to a North Carolina law requiring the use of bathrooms with the corresponding biological sex. Since they have added 23 states to the ban list, including Alabama, Arizona, Arkansas, Florida, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Mississippi, Montana, North Carolina, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, and West Virginia. Atkins' proposal would replace the restrictive regulations with a campaign to promote inclusivity.
The ban has posed a challenge for public universities, such as San Diego State, where the men's basketball team made it to the Final Four for the first time in its history but is prevented from paying for travel to Texas due to the prohibition. Consequently, the NCAA is covering the costs.
