Andrea Reeb, the special prosecutor in the case of the fatal shooting on the "Rust" movie set involving Alec Baldwin, has announced that she is stepping down from the role.

In a statement shared by the office of New Mexico's First Judicial District Attorney on Tuesday, Reeb stated, "After much reflection, I have made the difficult decision to step down as special prosecutor in the 'Rust' case." She added, "My priority in this case—and in every case I’ve prosecuted in my 25-year career—has been justice for the victim. However, it has become clear that the best way I can ensure justice is served in this case is to step down so that the prosecution can focus on the evidence and the facts, which clearly show a complete disregard for basic safety protocols that led to the death of Halyna Hutchins. I will not allow questions about my serving as a legislator and prosecutor to cloud the real issue at hand."

Last month, Baldwin's legal representative submitted a petition requesting Reeb be removed from the "Rust" case. This request came shortly after the actor was charged with involuntary manslaughter in relation to the death of Halyna Hutchins, who died on October 21, 2021, as a result of a gunshot from a firearm being held by Baldwin at the New Mexico set while they were rehearsing.

In the legal documents, Baldwin's attorneys contended that Reeb could not fill the position of special prosecutor and at the same time be a part of the New Mexico House of Representatives. They contended that doing so would "vest two core powers of different branches – legislating and prosecuting – in the same person and is thus barred by the plain language of Article III of the New Mexico Constitution."

Luke Nikas, Baldwin's attorney, cited the previous motion to have Reeb disqualified in response to her resignation and referenced the section that said there is "no question that Representative Reeb is violating both the plain text and the purpose of the New Mexico Constitution’s separation-of-powers provision by serving simultaneously as a legislator and a prosecutor."

Reeb previously conceded to reduce the charges against Baldwin and Gutierrez-Reed for the firearms sentence, as the law on which the enhancements were based did not apply when the shooting happened. This had been highlighted by Baldwin's representation and ultimately contributed to the filmmakers being able to stay away from a prison sentence if convicted.

If found guilty, Baldwin could face up to 18 months in jail. Gutierrez-Reed was also charged with two counts of involuntary manslaughter but has not yet entered a plea. Earlier this year, David Halls, Rust’s first assistant director, pleaded guilty to negligent use of a deadly weapon and received a suspended six-month sentence of unsupervised probation.
