Dem New Jersey AG Wants To Punish Cities That Do Not Include "Non-Binary" Option On Marriage Forms

A Democrat Attorney General in New Jersey wants to punish municipalities within the Garden State for only listing “male” and “female” on marriage application forms, reports the Daily Caller.

The Attorney General wants to fine those municipalities $10,000 if they don’t also add a “non-binary” option for people to tick if they decide that non-binary is the best description of their gender.

Attorney General Matthew J. Platkin announced on Wednesday that this would be the penalty for not making the change. Platkin and the New Jersey Division on Civil Rights (DCR) sent notices to 28 municipalities across New Jersey that warned that excluding “certain LGBTQIA+ individuals” violates New Jersey’s Law Against Discrimination (LAD). Cities will be subject to financial penalties unless they agree to change their license form and ensure all “gender-restrictive.”

On top of that, all government employees in the state will undergo anti-discrimination LAD training as a requirement.

“Marriage equality is not just the law. It is a fundamental right,” said Platkin during the announcement. He continued by saying:

“The marriage equality enforcement actions we are announcing today reflect our continued commitment to ensuring that municipal governments do not discriminate against couples seeking marriage licenses on the basis of their gender, gender identity, or gender expression.”

The New Jersey Department of Health offers marriage applications with a third option of “nonbinary applicants and other people with undesignated or unspecified gender identities” for those who wish to identify this way.

The Notices of Violation sent to those 28 municipalities are part of the New Jersey DCR’s Marriage Equality Enforcement Initiative, an effort that began in October 2022. This move meant to ensure that local governments provide “gender-inclusive and non-discriminatory marriage licensing applications,” based on what the Attorney General stated.

The department spoke with the Daily Caller News Foundation. It said: “The New Jersey Division on Civil Rights (DCR) resolves each enforcement action on an individual basis,” and “DCR is unable to provide further information at this time.”
