A 17-year-old Florida student reportedly beat a teaching assistant into unconsciousness.

According to the Post Millennial, even though he is underage, he will be tried as an adult.

Brendan Depa is the suspect in this case, and he allegedly assaulted Joan Naydich, 57, after she took away a video game he was playing in the class. He is facing one count of aggravated battery of a school board official. This charge is a first-degree felony in Florida that can be punishable by up to thirty years in prison.

The Daily Mail reports that after reviewing the situation’s circumstances, the Seventh Judicial Court of Florida ruled that Depa will face trial as an adult. They also ordered him to be held on bond for $1 million.

The Florida state attorney’s office had to argue for this to be the case. They argued that Depa “did actually and intentionally touch or strike [the victim] against [her] will.” And, in doing so, used a deadly weapon, and, or intentionally or knowingly caused great bodily harm, permanent disability, or permanent disfigurement.”

There is video footage of the alleged attack by Depa on Naydich. In that video, he knocked Naydich to the ground. He then went on to kick and stomp on her upper body and head repeatedly. The student is 6 foot 6 inches tall and weighs approximately 270 pounds. He is significantly larger than his alleged victim. It took as many as four people to pull him off Naydich.

The Post Millennial reports that Naydich was taken to the hospital to treat her injuries, but she has recovered and is doing much better. After the attack, someone set up a GoFundMe to raise money for Naydich “so that she can rest, heal and spend time with her kids without worrying about financial concerns right now.” As of this writing, GoFundMe received $60,000 to help Naydich.

The Daily Mail reports that this is not Depa’s first arrest for alleged acts of violence. In 2019, there were three incidents of suspected battery. In those cases, the Department of Juvenile Justice program was what Depa went through to put those situations behind him.

Depa is scheduled for arraignment on March 6 for these latest charges. There will be some developments yet to come in this case.
