Don't Mess With The Moms: 'Mama Bears' Settle Freedom Of Speech Lawsuit Against Georgia School District

A Georgia school district was ordered to fork over more than one hundred thousand dollars in legal expenses after forbidding mothers from displaying explicit material at the board of education sessions.

The Forsyth County School District (FSC) has consented to cover the legal fees of a federal lawsuit initiated by a set of moms called the Mama Bears, who were prohibited from speaking at school board meetings.

The Mama Bears argued in a federal court action that their First Amendment privileges were infringed, and the Institute for Free Speech successfully represented them in the trial, resulting in a victory.

After a member of the Mama Bears was stopped from reading explicit material during a school board meeting, the group initiated a federal court case which they eventually settled. The details of the agreement can be found here.

Mama Bears are to be compensated the amount of $ 17.91 for damages by FCS, and their lawyers will receive $107,500.

Del Kolde, a senior attorney for the Institute for Free Speech, informed Fox News Digital that shifting fees is a significant trait of our civil rights laws. Plaintiffs who prove that government officials censored them are allowed to have the wrongdoers pay their attorneys' fees, the same way as for any other type of unlawful discrimination. He hopes that school-board members and their legal counsels will take this into account.

The court prohibited the district and its related entities from preventing plaintiffs or any individual with the right to speak during an FCS school board meeting from citing or reciting the words from any book or written material found in the FCS library or classroom during the public comment section.

In February of the previous year, one of the members of the Mama Bears, Alison Hair, read sections of a book that was kept at her son's middle school library.

At the school board meeting, she perused a book known as "Extremely Loud and Incredibly Close" which contained a passage that reads, "I know that you give someone a blow job by putting your penis ..."

Mid-sentence, one of the board members interjected and stopped Hair from reading further from the book. Jonathan Safran Foer wrote "Extremely Loud and Incredibly Close" in 2005, a novel about a nine-year-old whose father had died in the 9/11 tragedy.

A year ago, in February, Alison Hair, part of the Mama Bears organization, looked through a tome that her son's middle school library possessed.

Hair insisted on exercising her right to speak during the public comment period and requested the board member not to interrupt her as she had a set time for it.

The following month, Hair made a second effort to read from the book during a school board gathering.

She received a letter from the board prohibiting Hair from attending school board meetings unless she complies with their policies, as the district alleged that she had broken the public participation policy of the school board meetings.

In July of 2022, the Institute for Free Speech initiated legal action on behalf of Hair, the Mama Bears of Forsyth County, and the leader of the Mama Bears.

In November, a federal judge declared the Forsyth County School Board's public participation policy unconstitutional and prevented them from enforcing it. Additionally, the court prohibited the district from forbidding Hair to speak at board meetings. This is according to the Institute For Free Speech.

At the beginning of this month, the Board of FCS cast their votes in favor of the settlement agreement, as per a statement made to Fox News Digital. The insurance firm covered the cost of the legal expenses.

On Monday, the FCS Board passed a public participation policy removing some of the old language and guidelines.

Parents from various parts of the United States have begun to take a more active role in scrutinizing school boards and their progressive curricula, as well as the books they deem inappropriate - a situation which is highlighted by the present lawsuit.

Voters have become increasingly focused on the subject of education, leading to organizations like the Oregon Moms Union. Since the Coronavirus pandemic, parents and school board members have been pitted against one another in school board meetings, which has sparked a renewed dialogue about how much influence parents have in their children's education.
