On January 30, an elderly rancher George Alan Kelly from Kino Springs, AZ, was arrested and charged with first-degree murder after fatally shooting a Mexican migrant on his land.

The 73-year-old has been held on a $1 million bond. The Ranch is located near Nogales Mexico.

George Kelly implored the judge to lower his bail amount so he could return to his home and care for his wife and ranch. “She’s there by herself… nobody to take care of her, the livestock or the ranch,” Kelly said, according to Nogales International. “And I’m not going anywhere. I can’t come up with a million dollars,” he added.

It has been indicated that the deceased, Gabriel Cuen-Butimea, has a precedent of unlawfully entering the United States and has been deported several times. He had a Mexican voting card on him.

The attorneys assigned to Mr. Kelly's defense asserted that he discharged warning shots when he saw a group of men wearing camouflage clothing aiming an assault rifle at him.

The legal representatives reported that George Alan Kelly had been cautious to fire above the individuals' heads.

Kelly eventually stumbled upon the body of the man when he went to inspect his horse. Fox News reported: “As the sun was going down later that day, Kelly went to his pastures to check on his horse, still concerned the horse might have been injured in the incident. Noticing that the dogs he took with him were focused on something on the ground near a mesquite tree, Kelly approached the area and “observed a body lying face down in the grass,” At that point Kelly called and requested assistance from the law enforcement.

Attorneys for the defense maintained that George Alan Kelly was within his rights to discharge his weapon if he believed that his and his wife’s safety was in jeopardy. “No Trespassing” and “Private Property” signs are all over the property.
